1. Summary

The Islamic Human Rights Commission has learned that Seyed Mahmood Mousavi has won his most recent court appeal. The following was reported on freeseyedmousavi.com:

“On Wednesday, May 5, 2010 the Ninth District Court of Appeal overturned the circuit court jury conviction of the immigration charges. Seyed Mahmood Mousavi is a free man and as a result of the reversal, continues to be a legal citizen of the United States. Seyed Mahmood Mousavi and his family sincerely thank you for your kind continued support.”

Seyed Mousavi had this to say to IHRC:

“I thank Allah that I am home with my family and I thank all the brothers and sisters for their prayers and supplications. Please continue to pray for me as we are still appealing other charges.”

2. Background

Mousavi served a total of 2 and a half years, being sentenced in April 2008 on felony convictions of an alleged violation of the US/Iran trade embargo, failing to report income, and lying on his naturalization application. Mousavi’s then attorney Ronald Kaye helped, with IHRC’s support, to dramatically reduce his sentence with the introduction of key testimonies.

Mysteriously, Mousavi was later transferred to Indiana’s notorious CMU (Communication Management Unit), a unit within the Federal Correctional Complex at Terre Haute. CMU, frequently nicknamed the ‘Muslim-only prison’, has been the issue of ACLU (American Civil Liberties Union) concern repeatedly over prisoner conditions and restrictions.

“And what reason have you that you should not fight in the way of Allah and of the weak among the men and the women and the children, (of) those who say: Our Lord! Cause us to go forth from this town, whose people are oppressors, and give us from Thee a guardian and give us from Thee a helper.”
